Council 'Land Swap' Farce
Because Cardiff Council failed to run the Maindy Park Trust in accordance with Charity Commisssion requirements the Council appointed an 'Independent' 3-man committee to 'advise' them if an independent Trust would recommend swapping some of their land to the Council can develop it, which also involves demolishing the historic, much loved, velodrome situated on the Trust;s land. The Council's offer of an alternative site is their existing Cae Delyn Park. After 3 meetings held between October 2022 and January 2023 the Advisory Committee ignored the evidence supplied by SMV&P and approved the Council's proposals, even claiming it would increase the area of green space (how building on Cardiff parkland increases the green space is clearly absurd).
So the Save Maindy Velodrome & Park campaign continue to have significant concerns over the Council's proposed 'land swap'. In following up our concerns SMV&P have prepared papers which cover the following issues:

Both the Council's Scrutiny Committee and Cabinet were not supplied with documents which were used by the Advisory Committee to reach their decision;

The chair of the Advisory Committee was asked to confirm the current amenity uses of the replacement land as they had not been provided with that information – unbelievably he didn’t know!

The Scrutiny Committee identified that the proposed replacement land at Caedelyn is in fact a flood defence system that comprises pitches that are booked out for training and matches (also means the land access is restricted for certain times of the day).

4 cabinet members were deemed to have a technical conflict of interest yet they were still allowed to take part in the decision. Under charity law a conflict is a conflict. All councillors also had a fiduciary duty to the resolved decision taken on the 14/10/21 to expand the school onto the charity land. Nobody at Cardiff council should have been allowed to take part in the land swap decision.

The council appear to be relying on a ruling for a case from around 15yrs ago (Failsworth) where the Charity Commission agreed to a land swap. However Commission guidance on managing conflicts has superseded the precedent set by this case. Also the Maindy Park situation is different in every major aspect.

The council have only sort counsel advice on Maindy Park to the benefit of the corporate body as developer – no independent legal advice has been sort on behalf of the corporate body as trustee to counter the proposal.

The Council have not followed Charity Commission guidance on managing conflicts.
The Council's actions in this matter sets a dangerous precedent where a Council can run a Charity in a negligent way, then set up an 'Advisory Committee' that fails to properly look into the matter (as demonstrated in the SMV&P papers). In effect, this ends proper Trust protection of any Charity land where a Council is the only Trustee. This is a clear abuse of power by the Labour run Council and SMV urge all Councillors of all parties to stop this abuse forthwith.

The Save Maindy Velodrome Campaign are asking people to send an objection to the Council on their latest survey in which they want to expand their 'land grab' at Maindy Park. See below for the link to object by 9th January.
Background
Cardiff Council want to build on the historic Maindy Park Velodrome and park. To do this they must remove a covenant and Trust protection. To remove the Trust protection they must ask the Trustee. This is where it gets a bit 'Alice in Wonderland'. Surprisingly Cardiff Council are the only Trustee so as 'developer' they have a huge conflict of interest. Charity Commission guidelines require Councils to run Trusts where they are the only Trustee as arms length organisations. Cardiff Council have failed to do this so they have set up a 3 man 'Advisory Group' of three 'independent' members co-opted from a Council Committee which, the Council tell us, is equivalent of an arms length Trust organisation except they can only 'advise'. The Council have told them to give them a recommendation on whether it is in the best interests of the Trust to 'land swap' part of the Trust land in Maindy with parkland the Council already own in Caedelyn. Despite that this will result in a net loss of parkland to Cardiff the 'Advisory Group' and it's rather absurd to suggest a Trustee of Cardiff parkland would endorse the Council's proposal, the 'Advisory Group' are being asked to formerly support the Council's 'land grab'.
In the latest twist, as part of this process Cardiff Council Cardiff Council issued a notice on 16th December in the Western Mail to advise they now plan to expand their 'land grab' at Maindy Park and Velodrome by over 30%. See the link below to send an objection to the Council.
Please note that, if successful, this route the Cardiff Council have chosen to remove Trust protection to cherished Cardiff parkland will create a precedent. All Cardiff parkland with Trust protection (such as Bute Park) will be open to development via approval of a Council run 'Advisory Group'. To inform people they plan to expand the 'land-grab' of Maindy Park Trust land the Council have again put a small notice in the Western Mail (which has a smaller circulation in Cardifff than the Echo). They also did not inform community groupd that they intended to do this.

Urgent Campaign Update:
We were all amazed that the Council is trying to get away with sequestering Maindy Park for its own building purposes by a tiny ad on one day which did not even draw attention to the fact that it affected Maindy Park or was even anything to do with Cardiff (this was only in the small print)
Lots of questions are being asked and people are clearly uncertain about what it means and things like the inconsistency between the maps published by the Council and those used by the surveyor has further confused people - perhaps intentionally
So we think it important to give our community an update on key questions/issues, what has been done, what is being planned, and how you can help (particularly points 8, 9 & 10)
Council’s failure to comply with the terms in the legal notice. As many of you discovered when you went to the website address given in the advertisement there was no information actually available. We have written formally to the Council, copied to the Charity Commission, asking for the Notice to be remedied and reissued
Public awareness. We got in touch with the media so that as many people as possible could be aware of the secret plan by the Council that threatens to withdraw the parkland status of part of Bute Park if Maindy Park Charity does not agree to exchange its land for the land already enjoyed by the public
Public meeting. Many of you have asked if there will be one. We shall be asking the local Councillors to hold one. If they won’t make arrangements for this to happen soon, then we shall look at calling one on the community’s behalf
Is it a done deal? Far from it. If the Council had everything they needed they would be steaming ahead. Yet nearly 2 years since they hatched the plan they are only just starting the process in respect of the Charity covenant. Your voice has prevented them so far - now, we need to act as a community to get it consigned to the bin
What does the land exchange mean? There is scant information from the Charity (aka the Council) and we have asked formally for all the details to be made available to the public so people can reach a properly informed view
Leisure centre, pool and BMX track are all affected by this. Whatever Councillors and Council officers may claim that these will remain, the simple truth is that by removing the covenant protection from these facilities, the Council at any time in the future – tomorrow, next week, next month, next year, whenever – will have a completely free hand to do whatever they like with them regardless of the wishes of the community
Why now? Labour wanted the local elections out of the way before trying to sneak this through as quietly as possible. The local Councillors in Cathays were clearly worried about the impact it may have had on their vote if this had been announced before the election
This may have to go to court. We hope that the Council will realise that they have compromised their position, and cannot resolve the conflict of interest between their duty as Trustee of the Charity to act independently and safeguard its assets with their role as the Local Education Authority. However, they have been intransigent so far and we may have to try and raise funds for legal (or other) action to challenge any decision made to the detriment of the community
Feet on the street. Once we know about a public meeting, we will produce info to go round the local community as not everyone is on social media – the fact that the Council is only using & allowing online communication deliberately discriminates against and excludes large numbers in our community. We will need help to make sure that as many homes as possible get the leaflet

Why should Maindy Velodrome be saved?

The recent public consultation made no mention of the track’s closure and neither has the statutory notice, but the velodrome is going to be demolished

It was home to Tour de France winner Geraint Thomas

The council say there will be a 'new' park. But the proposed 'new' park would only cover a third of the current Maindy site. So we would lose two-thirds of the Maindy site. At the moment the whole site is public space.

The new planned velodrome is not within the vicinity of the existing facility, and, because it will be smaller than Maindy, the user capacity will be lower.

It is an important sports facility and should be protected
The velodrome is on covenanted land which, in 1922 was given by the Bute Family to the people of Cardiff (2022 will be the centenary year). The covenanted land belongs to the people of Cardiff, not the Council! The council are Trustees, or guardians, of that land, tasked with cherishing it, protecting it and keeping it as open space in perpetuity on behalf of the people. Instead the council intend to 'land grab' this historic, much loved local amenity. The following are important points to note about the Maindy Park Charity of which the Council are sole Trustees:

Maindy Park was gifted to the people of Cardiff for recreation and leisure-time use

This use is protected in perpetuity (ie. for ever) by a charity covenant

Therefore, Cardiff Council’s plan to build on the site would constitute unlawful use of the land

The Maindy Park charity trustee is legally responsible for protecting the covenant from unlawful use
-
Cardiff Council is the charity trustee

Therefore, Cardiff Council has a conflict of interest in any decision about using Maindy Park for anything other than recreation and leisure-time use

The Charity Commission is the regulator and we have alerted them to this issue

The best way forward now is for Cardiff Council to recognise that their conflict of interest means they are unable to act in the best interests of the Charity and that they should allow independent trustee(s) to be appointed.
2022 marks 100 years, the centenary of the Covenant to land given by the Bute family to the people of Cardiff in 1922. The covenant is to ensure Maindy Park remains open space parkland in perpetuity for the people of Cardiff.
